What to Do Immediately after Your Motor Vehicle Accident
Protecting Your Health and Your Legal Rights after a Collision
In the moments immediately following a motor vehicle crash, the situation can be chaotic and confusing. Your first concern always needs to be your health, but there are important steps to take to protect your legal rights as well.
Get the Medical Care You Need
After any type of motor vehicle accident, whether it’s a fender-bender or a head-on collision, you need to stop and assess your injuries. It’s not the time to be strong or courageous—it’s the time to acknowledge that you’ve suffered a potential personal injury. If you have neck or back pain, or find it difficult to move under you own power, don’t try to. Be willing to stay right where you are until emergency medical personnel arrive. Once they do, defer to their expertise.
If your injuries seem minor and you are able to walk away from the accident, you still want to immediately seek medical attention, whether it’s in the emergency room at the hospital, at an urgent care facility, or from your doctor. Often, the adrenalin your body produces after a crash can mask some serious or debilitating injuries. The longer you wait to seek medical care, the greater the risk that defense attorneys will argue that your injury wasn’t serious or was caused by some subsequent event.
When you seek medical care, be sure to tell doctors and nurses about anything that’s out of the ordinary—stiffness, aches, fever, tenderness. Don’t focus on the obvious injuries—the cuts, bruises or broken bones, and neglect the less apparent physical effects. The most debilitating injuries—muscle, tendon and ligament trauma—can often take the longest time to show up. When you tell medical professionals about your injuries, make certain they document them in writing.
Safeguard the Evidence
The sooner you can start gathering information to support your legal claim, the better. The first thing you’ll want to do is get contact information for all parties to the accident, as well as any witnesses. That includes name, phone number, street address and e-mail address, if possible. If you are unable to reach out to people on your own, ask someone else at the scene to do so. Don’t rely on the police to gather that information, as it may or may not happen.
If at all possible, it’s always a good idea to get pictures. You don’t need a fancy camera—the one on your phone is fine. Take pictures of anything related to the crash—the current weather conditions, damage to the vehicles, injuries you suffered, and any irregularities with the roadways, such as potholes or broken pavement.
